- Artificial intelligence (AI) and machine learning algorithms have become increasingly common in many facets of modern life, from employment and healthcare to finance and criminal justice. While AI has the potential to improve decision-making and enhance efficiency, it can also perpetuate existing biases and discriminatory practices. As AI systems become more advanced and complex, there is a growing concern about the potential for algorithmic discrimination and the erosion of privacy rights. In response to these concerns, there have been calls and proposals expanding the protections provided by the Bill of Rights to include specific safeguards for data privacy and protection against algorithmic discrimination. This research paper will explore the intersection of AI, algorithmic discrimination protections, and data privacy from the perspective of the Bill of Rights. By examining relevant legal and regulatory frameworks and ethical considerations, this paper will explore how the Bill of Rights could protect individuals from the negative impacts of AI and algorithms, including discriminatory outcomes and data privacy breaches. Ultimately, this paper will consider how the Bill of Rights could be expanded to protect against algorithmic discrimination and ensure that individuals' data privacy rights are respected in the age of AI.
